The party of the first part, the website provider, Common Lands Network, located at R/ O Pazo 15, 36164 Pontevedra (Spain), with Tax Identification Number G94129475, telephone contact number (+34) 619663867 and email address hola@icomunales.org and the party of the second part, the user, registered at the website by means of a user name and password, who provides data for publication on the website, allowing public access, and who is fully liable for the use and safeguarding of which and for the truthfulness of the personal data submitted to the provider.
General information
Common Lands Network is a participatory online platform, designed to facilitate mutual understanding and collaboration between individuals, communities and organizations with ties to the commons in Europe, the Middle East and North Africa. As a participatory platform you can use it to give your work greater visibility, learn about the work being done by others and collaborate. By registering, you will be able to include your contact information in the directory, in addition to sharing sample cases, news, events and audiovisual material (videos, photographs, presentations, documents, audio). This content is usually posted within approximately five days. The content is subject to review by Common Lands Network, which will examine it, to determine whether it is complete, correct and appropriate. If it is not, the owner will be contacted to correct or adjust the data. In the event of improper use or misuse, the information will be removed and a decision will be made about whether or not the poster’s profile should be blocked or suspended. Users must use this website and its services in accordance with the law, public order and public morals, making appropriate use of them.
Further, the user undertakes:
- Not to provide information, links or content that are false, ambiguous or inaccurate and that may mislead third parties.
- Not to impersonate other users, real or fictitious.
- At all times, Common Lands Network reserves the right to remove or block, in whole or in part, any information or content provided by the user that violates the provisions of this clause at the moment that it becomes apparent.

This website is not intended for minors and we believe that it would be unlikely that a minor would use it.
Each profile will have a unique URL that the user can link to their blog, website, social networks or any other medium as they see fit to facilitate dissemination.
Additionally, the user complies with all the legal requirements to pursue the activity that they are promoting, and that the information that they have provided for their profile is correct and truthful. Likewise, they undertake to notify Common Lands Network of any change with respect to a variation in or cessation of these requirements.

Steps to register with Common Lands Network:
The user who is registering for the first time must fill out the form provided for that purpose (registration form).
The user must also choose an entity from among the following options: person, research centre/education institution, company, community that governs commons, association or federation of communities, NGO that does not represent communities or other entity.
Once the choice has been made and the registration form fields reviewed, the corresponding privacy policy and stipulated terms of use must be accepted.
The registration will be effective when the user has completed the registration process and it has been received by the provider. Until that time, the registration is not considered complete. Once this is done, the user will be able to see confirmation of their registration on the screen.
The provider assumes no responsibility when the registration is not completed because the data provided by the user are false, inaccurate or incomplete.
Notwithstanding the foregoing, we will adopt the measures required so that the registration can be completed in the agreed-upon time.
To unsubscribe from the service, the user must notify Common Lands Network at the following email account: hola@icomunales.org. Upon receiving notification, Common Lands Network will remove the profile of the registered user as quickly as possible. When you unsubscribe, you will be removing your profile from the directory, along with all the corresponding links that were generated. In the event that you do not want your data (activity history, profile and content) to be retained internally by Common Lands Network, you can exercise your date cancellation rights at the following email address: hola@icomunales.org. In the absence of any such notification, Common Lands Network reserves the right to internally retain the aforementioned data linked to the user.
Posts: articles/social networks/photographs/images/presentations/ideas/documents/events
On its website, Common Lands Network posts articles, documents, photographs, events, audio and videos uploaded to the platform by users who wish to do so, and who are registered in the directory, linking the authors to their Common Lands Network profile. To that end, users must upload their work to the platform, and the Common Lands Network website administrator will make a decision about posting it within a period of approximately five days.
The administrator reserves the right to post the articles, images, videos, photographs, presentations, audio and documents that they receive.
Respecting the authors’ freedom of judgement, the administrator can propose that works be adapted to the format and focus most in accordance with the Common Lands Network website.
Regardless of the date of the submission, the website will not post presentations, audio and documents, photographs or articles by users who have been registered, but who have unsubscribed at the time the content was going to be posted.
Common Lands Network reserves the right to remove, in whole or in part, any articles or images, audio, photographs or content in the event of becoming aware of their illegality.
Common Lands Network is not responsible for the truthfulness of the information or content provided by registered users and therefore not responsible for any inaccuracy, errors or misrepresentations in this information.
We do not want our platform to be used inappropriately, and consider it of utmost importance that the following principles be taken into account while using it:
- Do not provide false names or data.
- Do not provide false personal information.
- Do not access an account that belongs to another user.
- Do not post any content or perform any action on the application that infringes upon or violates the rights of third parties or violates any law in any way.
- The data entered on the platform must respect the right to honour and privacy, and the dignity and morals of persons, and not contravene public morals and public order.
- Common Lands Network has the right and obligation to remove or block, in whole or in part, any information or content provided by the user that violates the provisions of this clause at the moment that it becomes apparent, and take the legal action deemed appropriate in this respect.
Copyright and intellectual property.
Posts, photographs, documents, presentations, audio and images must cite the authorship and source.
Once the content has been posted, the author can provide a link to the content in their own blog or reproduce it in its entirety, with an explicit reference and an active link to the original post.
When an article is posted, the author will be identified by their name, email address and an image that can be of the author, the logo of the entity, the activity or an image related to the article. With other content, the email address and first and surnames of the author will also be visible. Some authors may voluntarily provide their telephone numbers to boost their visibility and contact through the platform.
News, photographs, audio, presentations, videos, events, documents, posts and so forth are included for the purpose of disseminating this content or as support for other related content, for which reason these data will be public and viewable by any web user.
Thus, when uploading content to the platform, the author authorizes its publication on the platform, as well as its later inclusion in other compilations and its dissemination through links from the platform or from social networks and other means.
The author is solely responsible for the originality of and opinions in the article, ensuring respect for copyright, which is extended to images and other graphic media provided to illustrate it.
The author declares that she or he is the author of the work and has all the intellectual and industrial property rights to its content. The author undertakes to assume all responsibility for any claims, including compensation for damages, that any third party may exercise against Common Lands Network on the assumption that their rights have been violated by any action arising from the obligations that the registered user assumes, directly or indirectly, with these terms of use. Likewise, the registered user undertakes to indemnify Common Lands Network from any damages that it may incur as a consequence of formalizing the transfer of rights regulated in this clause.
Further, all the content of the website, unless otherwise indicated, will be covered by the Creative Commons Attribution/Recognition-NonCommercial-ShareAlike 4.0 – CC BY-NC-SA 40 International Public Licence.

Through Common Lands Network, open profiles can be shared on different social networks and, as such, the user is informed that whatever the social network, the material uploaded to the platform may be shared by other users through said links.
All users can exercise the rights of access, rectification, cancellation and opposition at any time by sending:
- A letter by post, accompanied by a photocopy of an official document that identifies the person entitled to it, to: R/ O Pazo 15, 36164 Pontevedra.

Exemption from Liability
Common Lands Network does not guarantee the availability, infallibility and continuity of the operation of the website or the services offered. However, and as far as reasonably possible depending on the available resources, users will be warned about any interruptions or limitations that may occur or exist with respect to the operation of the website and its services.
In this respect, we will try to remedy any impairment, irregularity or limitation in the operation of the website and provision of the services defined on the platform as soon as possible.
Applicable law and jurisdiction
This website is subject to Spanish legislation, and in the event of any dispute or claim related to the use of this website, both parties submit to the jurisdiction of the courts of the city nearest Pontevedra (Spain). This clause of express submission to the courts of the city nearest Pontevedra is not extended to cases of dispute with web users who, in accordance with the legislation in force, have the status of consumers, in which case the provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these terms to the tribunals and courts where the user is located.
Further, the provider and the user will be able to submit their conflict to arbitration, as provided for in legislation covering arbitration and consumer and user protection, and the procedures for the extrajudicial resolution of conflicts established in codes of conduct and other self-regulatory instruments.
